Is this practice of advertising data as Unlimited yet its subjected to Fair Usage Policy a legal practice?

It’s always a good idea to read the small print in the contract. As long as they explain it then they are pretty much protected legally. This is a practice found in many places in the world, especially with mobile services. Verizon Wireless, for example advertises a unlimited mobile plan but once you hit 22GB they throttle your access speed.
